Terms and Conditions of Peak Uplift Digital
1. Introduction
These Terms and Conditions (“Terms”) govern the provision and use of digital marketing services provided by Peak Uplift Digital (“Company”). By accessing or using our services, you agree to be bound by these Terms.
2. Services
The Company offers various digital marketing services including, but not limited to, Google Ads, Facebook Ads, SEO, Email Marketing, and A2P messaging services. Each service is subject to the specific terms and conditions as agreed upon in the service agreement.
3. A2P Messaging Service Terms
As part of our services, we offer A2P messaging services. The following terms apply specifically to A2P messaging:
Program Description: The A2P messaging service is designed to provide notifications to users who opt-in to receive such messages.
Our campaigns send reminders to people who are in our customer database and opted-in previously via text and voicemail . There are rarely, if ever, any links in any of the text messages being sent. Examples: ‘Hi David, we scheduled a meeting for Tuesday at 1 pm. We are looking forward to meeting you again! Reply STOP to unsubscribe.’ ‘Hi David this is Emily. Are you still good for a meeting at 1pm? Btw, reply “STOP” to unsubscribe.’ ‘Hey Bob. Your meeting confirmation will be in your email shortly (check the spam folder just in case). Saurav, Peak Uplift Digital Reply STOP to unsubscribe.’ End users opt-in by visiting https://peakupliftdigital.com/contact-us/ and filling in their details. Users check a box to receive notifications & promotional messages from us to provide their consent. They can opt out at any time by texting STOP to (833) 480-1112.
You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for messages sent to you from us and to us from you. You will receive 1-2 messages/month. For questions about your text plan or data plan, contact your wireless provider.

4. Client Obligations
Clients are responsible for providing all necessary information and materials for their marketing campaigns. Clients must ensure that all content complies with applicable laws and regulations.
5. Payment Terms
Payment terms, including fees, payment schedules, and late payment penalties, will be specified in the individual service agreements or contracts.
6. Intellectual Property
All marketing materials created by the Company remain the intellectual property of the Company. Clients have the right to use these materials for the duration of the engagement.
7. Confidentiality
Both parties agree to keep all confidential information received from each other secure and confidential.
8. Liability and Indemnification
The Company is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Clients agree to indemnify the Company against any claims, damages, or expenses arising from their use of our services.
9. Termination
Either party may terminate the agreement with written notice. Upon termination, all outstanding payments will become due.
10. Governing Law
These Terms are governed by the laws of the state of Virginia.
11. Amendments
The Company reserves the right to amend these Terms at any time.
